General Terms and Conditions

The following Terms and Conditions (“Agreement” or “Terms and Conditions”) constitute a legal agreement between you (the user or customer) and Fortified Energy Systems Inc., a Nevada corporation ("Fortified Energy Systems,", “Company”, "we," "us," or "our"), governing your use of our website (https://environmentalpowerunit.com), your purchase of the epu™, and your participation in our affiliate and rebate programs and the terms and conditions thereof. By accessing our website, engaging in transactions, or participating in our programs, you agree to be legally bound by these Terms and Conditions.

1. General Conditions of Use

  • The website is designed for use by individuals aged eighteen (18) years or older. Access to and use of this website or any of its contents by anyone under the age of eighteen (18) is unauthorized and unlicensed.
  • We utilize digital tracking technologies to monitor activities on our website for the purpose of improving user experience and enhancing our marketing efforts. Your continued use of this site signifies your explicit consent to such data collection and monitoring.

2. Conditions of Sale

  • The epu™ and other related products are sold through this website, as well as offline through authorized company employees, contractors, distributors, and affiliates. All sales are governed by these Terms and Conditions. The completion of any sale transaction requires the customer’s express agreement to these Terms and Conditions, which is integrated by reference into any sales contract or agreement.
  • You shall not, and shall not permit any third party to, reverse engineer, decompile, disassemble, tamper with, or otherwise attempt to derive or access the internal components or underlying technology of any equipment, products, or software provided under this Agreement. Any such actions are strictly prohibited unless expressly authorized in writing by us. You acknowledge that any breach of this provision may result in immediate termination of this Agreement and may subject you to legal action for damages and injunctive relief.
  • You shall set up and use the EPU™ in a safe manner and strictly in accordance with the instructions provided by the Company. You responsible for ensuring that all personnel involved in the setup and operation of the EPU™ are adequately trained and informed of the safety protocols and operational guidelines as specified by the Company. You shall comply with all applicable laws, regulations, and industry standards related to the safe use of the EPU™. Any failure to adhere to these requirements shall constitute a breach of this Agreement. You shall promptly report any safety incidents or malfunctions of the EPU™ to the Company and shall cooperate fully in any subsequent investigation or corrective action.
  • You shall indemnify, defend, and hold harmless the Company, its affiliates, officers, directors, employees, agents, successors, and assigns (collectively, the "Indemnified Parties") from and against any and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of any kind, including reasonable attorneys' fees and professional fees (collectively, "Losses"), arising out of or resulting from the Affiliate's negligence or willful misconduct in connection with the misuse of the epu™ or the breach of this Agreement. "Losses" shall be defined broadly to include, but not be limited to, any direct, indirect, incidental, consequential, special, exemplary, or punitive damages, whether arising in contract, tort, or otherwise, and whether or not foreseeable, incurred by the Indemnified Parties.

3. Backorder and Payment Terms

Products available for backorder require a non-refundable deposit of $500. The remaining balance must be paid in full three days prior to the assigned shipping date as notified to the customer. Failure to complete payment as required will result in order cancellation, forfeiture of the deposit, and the reassignment of the product to a subsequent purchaser.

4. Affiliate Program Terms

  • Participants in the Affiliate Program are required to adhere to all pricing guidelines and promotional requirements as set by Fortified Energy Systems. This includes the mandatory placement of vehicle stickers and the posting of video reviews on designated social media platforms. Participants must access the affiliate portal to review detailed terms and conditions post-account creation. Immediate rebates and commissions are awarded based on compliance with these terms, which may be amended by Fortified Energy Systems at any time without prior notice 
  • Fortified Energy Systems retains all rights, title, and interest in and to all Intellectual Property, including but not limited to patents, know-how, trademarks, copyrights, trade secrets, and any other proprietary rights, whether registered or unregistered, and any applications for such rights, in any jurisdiction worldwide. For the purposes of this Agreement, "Intellectual Property" shall be broadly defined to include any and all inventions, discoveries, processes, designs, methods, formulas, techniques, improvements, and any other intellectual or industrial property rights with respect to the epu™. You acknowledge that, except for the rights expressly granted to you, no other rights or licenses are granted, whether by implication, estoppel, or otherwise. We reserve all rights not expressly granted under this Agreement.

5. Rebate Program

Eligibility for rebates under the Rebate Program is conditional upon compliance with the following terms:

  • First Video Review: A $500 rebate is awarded for a video review posted within two weeks of receipt of the epu™ on platforms such as YouTube, Facebook, or Instagram. The video must be pre-approved by Fortified Energy Systems and must remain accessible on the platform following rebate issuance.
  • Second Video Review: A subsequent $200 rebate is granted for a second approved video review posted on a different social media platform.
  • Unmounting Current APU: A $1,200 rebate is available for providing verified evidence (including video proof and accompanying receipts) of the unmounting of an existing APU.

Failure to adhere to the specified terms for any rebate program will result in the forfeiture of the rebate

6. Return and Refund Policy

Returns of the epu™ are permissible within ten (10) days of delivery, provided the product is unused, undamaged, and in its original packaging. Customers are responsible for all return shipping expenses. Refunds are processed only after the returned product is inspected and confirmed to be in its original condition. Products that have been used, installed, or altered are not eligible for return or refund.

7. Warranty Provisions

The epu™ is provided with a two-year warranty against defects in materials and workmanship, assuming normal use and in compliance with the provided installation instructions. This warranty also ensures that the epu™ is  of merchantable quality, fit and safe for its intended purpose, and conforms to applicable specifications. This warranty is void if the product is tampered with, improperly installed, or modified in any way.

8. Consent to Communications

By agreeing to these Terms and Conditions, you authorize Fortified Energy Systems to send communications pertaining to your transactions and promotional information about new products via email, text, or telephone.

9. Financing and Payment Default

Financing options are made available through reputable third-party financiers or our dedicated in-house financing department. The precise terms of financing arrangements will be disclosed at the time of purchase to ensure transparency and clarity. In the event of non-compliance with the stipulated payment terms, temporary deactivation of the product may be implemented as a protective measure to uphold the integrity of the financial agreement and address any payment delays in a timely and professional manner.

10. Legal Jurisdiction and Modifications

These Terms and Conditions shall be governed by the laws of the State of Nevada. Any disputes arising hereunder shall be resolved through arbitration. The parties each agree to select an arbitrator by mutual agreement within 30 days of a dispute arising. If the parties cannot agree on an arbitrator within this period, each party shall select one arbitrator, and the two arbitrators shall select a third arbitrator, who will serve as the sole arbitrator for the dispute. Fortified Energy Systems reserves the right to modify these Terms and Conditions at any time. Changes take effect immediately upon their posting on the website.


Limitation of Liability

Fortified Energy Systems shall not be liable for any special, indirect, incidental, or consequential damages that may arise from the use of, or the inability to use, the website or any purchased products, even if we have been advised of the possibility of such damages. These limitations apply regardless of whether such damages were foreseeable, whether we were advised of the possibility of such damages, and the legal or equitable theory (contract, tort, or otherwise) upon which the claim is based.
